2. Our Services

INcounting provides online services related to business data processing, accounting, and tax consultancy. These services may include automated data entry, bookkeeping support, tax preparation, financial reporting, and AI-enhanced insights to assist your business operations and compliance in New Zealand.

3. Acceptance of Terms

  • 3.1 By signing in or registering an account on INcounting, or by accessing or using any part of our website, you agree to these Terms of Use and our Privacy Policy.
  • 3.2 These Terms may be updated from time to time. The latest version is always available at the footer of our website.
  • 3.3 INcounting reserves the right to change or discontinue services, pricing, or availability at any time.
  • 3.4 “You” refers to both individuals and any business entity you represent. “We”, “us”, or “INcounting” refers to INcounting Ltd.
  • 3.5 Your continued use of our services is contingent on maintaining an active user account and a sufficient deposit balance.

4. Payment and Invoicing

  • 4.1 INcounting operates on a prepaid account model. Users are required to maintain a positive balance (prepaid deposit) before services can be rendered.
  • 4.2 Service fees are deducted automatically from your deposit at the time services are performed. An invoice will be issued immediately and emailed to the registered email address.
  • 4.3 You may request a refund of your remaining deposit at any time, and the balance will be returned within 7 working days to your nominated account.
  • 4.4 Invoices include all applicable taxes, including GST (Goods and Services Tax). The GST amount will be shown clearly on each invoice.
  • 4.5 INcounting may suspend services if your deposit is insufficient or payment authorization fails.

5. Credit Card and Payment Security

  • 5.1 All payments are processed through secure third-party payment providers.
  • 5.2 INcounting does not store any credit card details on our servers or systems.

6. Refund and Dispute Resolution

  • 6.1 If you are dissatisfied with our services, please contact us within 14 days of service delivery to discuss your concerns.
  • 6.2 In line with the New Zealand Consumer Guarantees Act 1993, you are entitled to a refund for any service with a major fault or failure that cannot be remedied.
  • 6.3 Refunds for prepaid balances (deposits) are always available upon request, subject to deduction of fees for services already rendered.
  • 6.4 If you experience issues, we recommend contacting us before withholding payment or initiating disputes.
  • 6.5 If we are unable to resolve your concern informally, disputes may be referred to the New Zealand Disputes Tribunal or handled via arbitration.

9. Termination

  • 9.1 We may suspend or terminate your access if:
    • Your deposit balance is insufficient
    • You breach these terms
    • Payment authorization is revoked
    • We are unable to provide services due to events beyond our control
  • 9.2 If terminated for external reasons (e.g., force majeure), we will refund any remaining prepaid balance.
  • 9.3 We may refuse service or terminate access if we receive reports of abuse, fraud, or unacceptable behavior, with or without notice.

10. Warranties and Disclaimers

  • 10.1 All services are provided “as is” without warranties of any kind, except as required by law.
  • 10.2 We do not guarantee uninterrupted access or that services will be error-free or virus-free.
  • 10.3 We do not provide legal, tax, or accounting advice unless explicitly stated.

11. Limitation of Liability

  • 11.1 Our total liability is limited to the amount you paid for services in the 12 months prior to the claim.
